These Terms of Service ("Terms") are a legal agreement between you and RV Phoenix LLC ("RV Phoenix," "we," "us," or "our") governing your access to and use of the website www.rvphx.com (the "Site"), our SMS messaging program, and any reservation or rental inquiry you submit through the Site. By using the Site, submitting a reservation request, or opting in to receive SMS messages from us, you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old to use the Site or submit a reservation request. To rent an RV from RV Phoenix you must meet additional requirements, including minimum age, a valid driver's license, and the insurance and deposit requirements set out in our rental agreement. Those requirements are part of your rental contract, which you will sign separately.
2. Reservations and the Rental Agreement
The Site allows you to request a reservation. A reservation request is not a binding rental until we confirm it and you sign our separate rental agreement at or before pickup. All RV rentals are subject to that rental agreement, which controls the rental relationship (deposits, fees, mileage, insurance, damage, fuel, cleaning, late returns, prohibited uses, cancellation, and similar matters). Nothing on the Site modifies that agreement.
3. Payment, Deposits, and Cancellations
Payment terms, deposit requirements, and cancellation rules are described in your rental agreement and on the Site. Charges may include rental fees, security deposits, mileage, cleaning, fuel, late-return fees, damage, and applicable taxes. You authorize us to charge the payment method you provide for amounts owed under your rental agreement.
4. SMS Messaging Program
By providing your mobile number and checking our SMS consent checkbox, you expressly consent to receive text messages from RV Phoenix LLC related to your rental, including reservation confirmations, pickup and return reminders, balance-due notices, vehicle pickup instructions, and customer service responses. Messages are transactional and customer-service oriented; we do not send marketing texts through this program.
Message frequency varies based on the status of your rental. Message and data rates may apply. You may reply STOP at any time to opt out and HELP for help. We will treat STOP as a withdrawal of your consent and will stop sending you SMS, except for one final confirmation message. Opting out of SMS does not affect non-SMS communications such as email or phone. Our complete SMS practices are described in our Privacy Policy.
5. Acceptable Use of the Site
You agree not to (a) use the Site for any unlawful purpose; (b) attempt to interfere with the Site's operation or security; (c) reverse-engineer, scrape, or copy any part of the Site except as expressly permitted; (d) submit false, misleading, or fraudulent reservation information; or (e) use the Site to harass, abuse, or defraud RV Phoenix or any other person.
6. Intellectual Property
The Site and its contents — including text, graphics, logos, photographs, and software — are owned by RV Phoenix LLC or its licensors and are protected by United States and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Site without our prior written permission, except that you may view and print pages for personal, non-commercial use.
7. Disclaimers
The Site is provided "as is" and "as available." To the fullest extent permitted by law, RV Phoenix disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. RV-rental services themselves are governed by your rental agreement.
8. Limitation of Liability
To the fullest extent permitted by law, RV Phoenix and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the Site or our SMS program, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim arising out of or relating to the Site or the SMS program will not exceed one hundred U.S. dollars ($100). Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be limited by law.
9. Indemnification
You agree to indemnify and hold RV Phoenix and its owners, officers, employees, and agents harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Site in violation of these Terms; (b) your violation of any law or third-party right; or (c) any information you submit through the Site that is false, misleading, or fraudulent.
10. Governing Law and Venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Site will be the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the revised Terms on this page with a new "Last Updated" date. Material changes will be highlighted on the Site or communicated to you directly when appropriate. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
